What is a private loan?

A private loan is money lent by one individual to another on mutually agreed terms, without a bank and without a licensed lender. In Lithuania such a transaction is governed by the Civil Code (Articles 6.870–6.875, the loan agreement).

No bank bureaucracy

You do not need an income certificate, a credit-history check or an employer's confirmation — the parties agree on everything themselves.

Flexible terms

The parties freely agree on the interest rate, repayment schedule and term. The law sets no maximum annual rate between individuals (unlike licensed lenders under the Consumer Credit Law).

A written agreement is essential

To protect both sides and keep evidence in court, the agreement should be made in writing. The portal offers a free loan-agreement template.

Tips before a loan

  • Always make the agreement in writing — even when lending to a relative.
  • Verify the other party's identity — ID document and address.
  • Never pay any 'fees' up front — that is the most common scam.
  • If the sum exceeds €3,000, choose a notarised agreement.
  • Mind the taxes — interest received is the lender's taxable income (GPM 15%).

A private loan in Lithuania is money lent between individuals, where neither side is a bank or a licensed lender. It is a loan from a private person — a simple civil transaction governed by the Civil Code (Articles 6.870–6.875, the loan agreement).

What the Civil Code governs

A loan agreement between individuals is deemed concluded from the moment the money is handed over (Art. 6.870). The parties set the interest themselves; a court may reduce clearly excessive interest (Art. 6.37). How this works in practice — on the page private loans.

Frequently asked questions

Is a private loan legal in Lithuania?
Yes. The Lithuanian Civil Code (Art. 6.870–6.875) allows individuals to enter into loan agreements. No licence is needed unless lending is systematic business activity.
What is the maximum interest rate?
Between individuals the law sets no maximum. However, a court may reduce clearly excessive (usurious) interest under Art. 6.37 of the Civil Code.
Do I have to pay tax?
Yes — the lender must declare interest received as income (GPM 15%). The principal itself is not taxed.
